Dareback general terms and conditions

For using Dareback.com and taking part in games and challenges

Version 1.0-en · English translation of version 1.0, effective 11 October 2026

These terms govern your use of Dareback.com. The submission and publication terms in Part B also apply when you submit or publish photographs, text, video, audio or other files. Read both parts before taking part or submitting anything.

A1 Provider and contact

Dareback.com is provided by Publimix, Zijl 19, 1862 HL Bergen, the Netherlands, registered with the Dutch Chamber of Commerce under number 34193566, referred to below as Dareback or we. Contact: info@dareback.com. Reports about submissions and rights: mailto:info@dareback.com or info@dareback.com. Privacy enquiries: info@dareback.com.

A2 Scope and acceptance

These terms apply to use of the website and accounts, and participation in the games and challenges offered. You accept them by ticking the agreement box before registration, participation or submission. We make the terms available beforehand in a form you can save.

Additional rules may apply to a particular challenge. These are announced before participation. If they conflict with these terms, the additional rules take priority for running that challenge. Any extension of publication rights requires separate, clear agreement. Mandatory legal rights remain unaffected.

A3 Participation and accounts

Participation is only permitted from the age of 18 and is free unless different terms are separately agreed in advance. You provide accurate information, use an account you are authorised to use and keep your login details confidential. Report suspected misuse of your account to Dareback immediately.

You must not impersonate someone else. You remain responsible for your own actions and submissions. An account does not give you ownership of the platform or a right to continued access contrary to these terms.

A4 Taking part safely and lawfully

Only carry out a challenge if it is safe and permitted. Consider your health, your surroundings, other people, animals and property. Stop if conditions become unsafe. Do not trespass or put anyone in danger, and obtain permission where needed.

Participation is not an instruction to break laws, safety rules or the rights of others. Dareback may refuse or remove unsafe challenges or submissions. Participants' own responsibility does not affect Dareback's statutory duties of care.

Part A continued

A5 Prohibited use

You must not use the website for harassment, discrimination, threats, fraud, doxing, impersonation, spam, malicious software or infringement of others' rights. You must not bypass security or disrupt the service. Submissions must comply with Part B.

A6 Game rules and any prizes

For each challenge we state the participation requirements, deadlines and assessment method. For a competition with a prize we also publish the prize, selection procedure, announcement arrangements and any restrictions in advance. You are only entitled to a prize if the specific rules provide for it. Fraud or a material breach may lead to exclusion; we will explain the reason.

We only change or end an ongoing challenge if there is a reasonable cause, such as a safety risk, fraud or a technical fault that makes fair operation impossible. We inform participants of the reason and consequences and take their legitimate interests into account.

A7 Moderation and access

We may check submissions through human review and technical checks for file type, malware and spam. Checking or publishing material does not confirm that all rights have been obtained. We may refuse, temporarily restrict access to or remove material that breaches these terms, is subject to a credible rights complaint, poses a safety risk or must be removed by law.

For serious or repeated breaches we may restrict or terminate an account. We choose a proportionate measure and, where legally required, provide a reasoned notice explaining the available ways to challenge the decision. Urgent measures may precede that notice. You can request a review via info@dareback.com.

A8 Availability and Dareback's liability

We aim to provide a website that works well. Maintenance, faults or changes may temporarily limit the service. Keep your own copies of files: the website is not an archive service. We handle reports of faults and misuse carefully.

The statutory rules apply to damage for which Dareback is legally liable. Dareback does not exclude liability for intent or deliberate recklessness by its management, personal injury for which it is liable, or other liability that cannot lawfully be excluded. Part B governs submitters' responsibility for infringement of third-party rights.

A9 Privacy and termination

Our separate privacy notice at https://dareback.com/privacy/ explains how we process personal data and your rights. Accepting these terms is not general consent to all processing of personal data or to marketing.

You can terminate your account via mailto:info@dareback.com. We end access and handle data and submissions in accordance with Part B and the privacy notice. Statutory retention duties and existing disputes may require limited retention.

A10 Changes and disputes

We may change the terms for future participation. For material changes we inform existing users in advance and request fresh agreement before they take part under the amended terms. A change does not retrospectively extend the licence for earlier submissions.

Dutch law applies. Consumers retain the protection of mandatory law in their country of residence insofar as applicable. Disputes may be brought before the court that has jurisdiction under the law. An invalid provision does not affect the remaining provisions insofar as they can continue to apply independently.

Part B submission and publication

These terms apply to photographs, text, video, audio, images and other media files that you send or upload to Dareback, including titles, captions and accompanying information. Together these are called the submission. By agreeing before submission, you undertake to comply with these terms.

B1 Submitter's rights and authority

You declare that you created the submission yourself and hold the necessary rights, or that all rights holders have demonstrably authorised you to submit it and grant the licence in B4. Merely possessing a file, crediting its creator or finding it online is not sufficient.

Before submitting, you obtain all necessary permissions and rights. Where applicable, this includes copyright, related rights of performers and producers, music, images, text, artworks and other protected elements in the submission. A licence for private use or use within another app does not automatically cover publication on Dareback.com.

You identify the correct creator and any agreed attribution. You disclose restrictions before submitting. If those restrictions conflict with B4, do not submit the material. You retain evidence of your authority and provide relevant evidence in response to a reasoned request, redacting data that is not needed for that purpose.

B2 Identifiable people and personal data

Only submit material containing identifiable people if each identifiable person has demonstrably, freely and specifically consented in advance to public publication on Dareback.com and the processing necessary for it. Explain that the website is public and visitors can view and may copy the submission. Consent must also cover the chosen caption and context.

For identifiable minors, Dareback requires written permission from the authorised legal representative or representatives and involvement of the child appropriate to their age and understanding. If authority or agreement is in doubt, do not submit the material. Dareback may refuse submissions featuring minors.

Do not publish home addresses, private contact details, identity documents, precise private locations or other unnecessary personal data. Avoid material revealing sensitive data, for example about health, religion or sexuality. Only submit such material after separate prior assessment and agreement by Dareback.

If consent is withdrawn or you discover that permission or a right is missing, notify info@dareback.com immediately, identifying the submission concerned. The submitter's agreement never replaces another person's consent or rights.

B3 Content and authenticity

A submission must not contain unlawful, abusive, hateful, threatening, sexually exploitative or privacy-infringing content. It must not encourage unsafe or criminal acts. Do not submit malware, confidential information or misleading allegations about others.

Disclose relevant edits and AI-generated elements. Do not present edited or generated images as authentic evidence of participation. Do not misleadingly imitate someone's appearance or voice. The same rights and consent requirements apply to every element, regardless of the technology used.

Part B publication rights

B4 Licence for Dareback

Copyright and any other rights in the submission remain with the rights holders. To the extent you are authorised to do so, you grant Dareback a non-exclusive, worldwide licence to store, reproduce and make the submission publicly available on Dareback.com. The worldwide scope reflects the website's worldwide accessibility.

The licence covers use in the relevant challenge, on your public profile, on overview pages, in galleries, rankings and results on the website, and the technical processing needed for these uses. For those purposes Dareback may display, stream, convert, compress, resize, crop and add technically necessary subtitles or formatting to the material.

We do not make substantive changes that misrepresent your contribution or harm your reputation. The creator's moral rights remain unaffected. When publishing, we credit the stated creator or agreed pseudonym insofar as reasonably possible. Report incorrect or missing attribution to info@dareback.com.

Dareback may grant hosting, storage, security and other technical service providers the rights they need to carry out these tasks for Dareback. This does not give them an independent right to use the submission for their own advertising, sales or other purposes.

The licence permits publication on a website with advertising or sponsorship, but not use of your submission as an endorsement of a sponsor or product. Use on social media, in newsletters, advertisements or print, sale to third parties, or training AI models falls outside this licence. For such use we make a separate agreement, where needed also with other rights holders and depicted people.

B5 Payment and publication

No payment is agreed for use within B4, except under a separate agreement or where mandatory statutory entitlements apply. Any competition prize is separate from payment for publication. You may also use your own material elsewhere or license it to others.

Submitting does not guarantee publication, reach, assessment or a prize. Dareback may select material and end publication on the grounds in A7. Publication does not give visitors general permission to republish your material.

B6 Duration and termination of the licence

The licence applies for as long as the submission is used on Dareback. You may terminate it for future use by requesting removal via mailto:info@dareback.com or info@dareback.com. Identify the submission and explain how we can verify your authority. We stop new publications and remove the submission within 30 days of a sufficiently clear request, unless the law requires earlier action.

After termination we do not reuse the submission. Only limited, non-public retention for legal obligations, evidence of previously granted rights, a specific dispute or a normal secure backup cycle remains possible for as long as there is a legal basis. Backups are not used for new publication. Termination does not retrospectively make previously lawful use unlawful.

B10 applies to withdrawal of privacy consent and other privacy rights. We cannot always remove copies made by independent third parties outside our control. This does not limit our statutory duties to take appropriate measures.

Part B responsibility and complaints

B7 Submitter's responsibility

You are responsible for the accuracy of your declarations, the lawfulness of your submission and obtaining the rights and permissions in B1 and B2. You reasonably cooperate with complaint investigations and report missing rights or a change in consent as soon as possible.

B8 Liability and indemnity

If you breach an obligation under these terms and that breach is attributable to you, you are liable under the statutory rules for the resulting damage. To the extent legally permitted, you indemnify Dareback against justified third-party claims arising directly from that breach, for example because you submitted material without the required rights or consent.

This indemnity only covers demonstrable damage and reasonable, necessary defence and handling costs that should legally be borne by you. A claim, fine or invoice is not automatically passed on to you. Dareback must substantiate the legal basis, attribution, causation and amount, and take reasonable steps to limit damage.

Dareback informs you of a relevant claim as soon as reasonably possible and gives you an opportunity to provide information and be involved in handling it. Without your prior agreement, Dareback does not enter into a settlement requiring you to pay, unless a legal obligation requires otherwise.

The indemnity does not apply insofar as damage is caused by Dareback's own unlawful conduct, use outside the granted licence, unauthorised editing or wrongly retaining material after a sufficiently substantiated report. Dareback's own statutory duties remain unaffected. Mandatory consumer protection and other rights that cannot be excluded are not limited.

B9 Infringement reports and removal

Anyone may report possible infringements via mailto:info@dareback.com or info@dareback.com. Provide the exact URL or submission identifier, an explanation of the alleged infringement, relevant evidence, your name and email address, and a declaration that the report is accurate and complete to the best of your knowledge. Where the law requires or permits anonymous reporting, we offer that option. Reporting does not require a participant account.

We acknowledge receipt when contact details are available, assess reports promptly, carefully and objectively, and inform the reporter of our decision and available remedies. Where necessary, we restrict access to or remove material during investigation. In urgent cases or clear unlawfulness, we act as quickly as needed.

Where legally required, we also inform the submitter, giving specific reasons and ways to object. You can request a review via info@dareback.com. This does not affect statutory complaint procedures, out-of-court dispute resolution or access to the competent court.

B10 Privacy and withdrawal of consent

Dareback must have its own valid legal basis for processing personal data in submissions and publications. Where processing is based on consent, the person concerned may withdraw it easily at any time via info@dareback.com or mailto:info@dareback.com, without charge or penalty. We then stop that processing unless an independent valid legal basis permits limited further processing. Previously lawful processing remains lawful.

A depicted person's request does not require the submitter's agreement. We handle privacy requests within the statutory time limits. A copyright licence does not remove privacy or portrait rights. Our privacy notice contains further information, retention periods and complaint options.
